Terms and conditions of sale

1. Purpose

These terms and conditions of sale define the conditions under which the agency eVisibility provides its clients with website design, search engine optimisation (SEO), marketing campaign, AI automation and web maintenance services.

2. Quotes and orders

Any request made on the website, in particular via the quote request page, results in a costed quote sent by email. The quote is valid for 30 days from its date of issue.

The order is definitively confirmed upon receipt of the signed quote bearing the words “Bon pour accord” (approved) and payment of the deposit provided for in the contract (generally 30% to 50% of the total amount).

3. Payment terms

Unless otherwise agreed in writing, payments are made according to the following schedule:

• a deposit when the services begin;
• interim payments on delivery of milestones (mock-ups, development, pre-production);
• the balance at go-live or final delivery of the project.

Payments are made by bank transfer or by cheque payable to eVisibility. In the event of late payment, statutory late-payment penalties apply after prior formal notice.

4. Maintenance and liability

For custom development and maintenance services, eVisibility undertakes to provide work that complies with professional standards and with the approved specifications.

Our liability is limited to the value of the invoiced service. We cannot be held liable for loss of revenue due to service interruptions beyond our direct control (outages of a third-party host, external hacking, browser updates or changes to Google’s algorithms).

5. Termination and disputes

If the client cancels the order during the project, the deposits paid remain with eVisibility to cover the work already carried out.

These terms are governed by Moroccan law. Failing an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the competent courts of Agadir.
